Trump nominates Catholic for Supreme Court

Brett Kavanaugh, President Donald Trump's nominee to replace Justice Anthony Kennedy on the Supreme Court, is a longtime judge on the federal appeals court often referred to as the second-highest court in the land. The issue may eventually come before the Supreme Court, where Kavanaugh's view of the CFPB could prevail.

"Anyone who doubts Kavanaugh's bona fides should keep in mind: this president has an exceptional track record on the judiciary", says FRC's Tony Perkins. "Throughout his judicial career, Judge Kavanaugh has demonstrated a strong commitment to upholding the law, rather than legislating from the bench".

"He was nominated by President Trump, he owes his nomination to President Trump, and with an issue of this magnitude regarding President Trump, will he be able to be independent and evaluate the arguments on both sides with no feeling of obligation or being beholden to the person who put him in the job in the first place?"

Kozinski, appointed by Ronald Reagan to the 9th Circuit, served on the court from 1985 until 2017, and was known as a "feeder judge", sending nine of his clerks to work for Supreme Court justices between 2009 and 2013 alone. The report outlined in broad detail grounds on which to impeach President Clinton for his role in the Monica Lewinsky scandal.

He fought on the legal team urging Florida not to have a recount in the 2000 presidential election between Bush and Al Gore, Clinton's vice president.

"A seat on the Supreme Court would let Kavanaugh and his allies expand attacks on the ability of government to regulate and enforce the rules on behalf of ordinary people", said Linda Jun, senior policy counsel at Americans for Financial Reform. But after serving in the administration of President George W. Bush, Kavanaugh's opinion changed. The case said that religious employers did not have to provide contraceptives but had to file a form telling the government they were not doing so, but Kavanaugh argued that the requirement violated religious freedom.

He routinely decides for the powerful against the powerless when safety, equality, consumer rights, the environment and workers protections are at stake. Trump also has suggested he could pardon himself. He was a key vote in several highly contested issues including abortion, affirmative action, gay rights, guns, campaign finance and voting rights.

The centrist Anti-Defamation League was also wary of Trump's nominee.

Stabenow said in a Monday statement that the vacancy "represents a very consequential moment for our country where we can chose to make progress on so many important issues for MI families or we can turn the clock back". More than half of that was royalty payments for the books he had written. Plus, Kavanaugh has a conservative record on abortion, but he has also testified to the Senate in the past that he would respect Roe.

That said, it is a decision that is entirely up to Senate Judiciary Committee Chairman Chuck Grassley, and the Iowa Republican made clear to CNN's Manu Raju on Tuesday that he needs time to get his arms around the scale of the documents and review process before he locks in a timeline.
